Changes to the statement of employment particulars

Employers will have to provide new-form employment particulars (often referred to section 1 statements) to employees, and workers from day one of employment.

On 6 April 2020, the requirement for employers to provide a written statement of employment particulars (in accordance with section 1 of the Employment Rights Act 1996) is changing. Employers should note:

  • Written statements will need to be provided to all workers, whereas at the moment this requirement only applies to employees. 
  • Currently this right to a written statement only arises once an employee has one month’s service.  
  • Written statements will need to include more information than current requirements.  While these changes do not apply retrospectively, from 6 April current workers will be entitled to request a written statement including the additional information. Employers will need to comply with these requests within one month.
  • These changes specify what information must be provided in a single document, and what can be provided separately. 

Employers are advised to review their current documentation to ensure it complies with the new requirements.
